Terms and Conditions of Sale (CGV)
Zohra Capucine – Upcycled and Handmade Textile Creations
1. Seller Identification
These Terms and Conditions of Sale (“T&Cs”) apply to all sales made through the website https://zohracapucine.com, operated by:

2. Purpose
These T&Cs define the rights and obligations between the seller and the customer regarding the online sale, in-person collection, or rental of unique, upcycled textile pieces handcrafted in Belgium.
By placing an order, the customer fully accepts these Terms and Conditions.
Each item is handmade and may present small variations in color, texture, or finish, inherent to the artisanal and upcycling process.
3. Products
The products offered for sale are described and photographed as accurately as possible.
However, slight differences may occur between the photographs and the actual product. These variations cannot be considered defects or grounds for complaint.
Products are offered subject to availability. In the event of unavailability after an order, the customer will be notified by email and refunded.
4. Prices
All prices are listed in euros (€), inclusive of VAT, but excluding shipping costs.
Shipping fees are calculated according to destination and package weight (see section 7).
5. Orders
By placing an order on https://zohracapucine.com, the customer agrees to these Terms and Conditions in full.
The customer must provide accurate and complete information when placing an order.
Zohra Capucine reserves the right to cancel any order in case of previous payment issues or suspected fraud.
6. Payment
Payment is made online by credit or debit card, via a secure payment platform (Stripe).
No payment data is stored by the seller.
The order is confirmed only after payment has been successfully processed.
7. Delivery and Collection
Available methods:
Mondial Relay delivery to pickup points in Belgium, Luxembourg, the Netherlands, France, Germany, Spain, and Italy.
Click & Collect by appointment in Brussels.
Custom orders and rentals: collection and return by appointment.
Delivery times:
Processing and dispatch within 7 business days after payment confirmation.
Transit time: approximately 3 to 5 business days, depending on destination.
The seller cannot be held responsible for delivery delays or loss due to the carrier.
Shipping Rates :
All orders placed on this website are subject to fixed shipping rates. Shipping costs are determined based on the destination and the weight of the package, according to the fixed rate grid below. These rates are applied automatically at checkout.
8. Right of Withdrawal
In accordance with Belgian and EU consumer protection laws, the customer has a 14-day withdrawal period from the date of receipt of the order, without having to provide any reason.
Returns are at the customer’s expense and must be sent back in their original condition, unworn, unwashed, and with original packaging intact.
Exceptions:
Custom or made-to-order pieces cannot be returned or exchanged (Article VI.53 of the Belgian Economic Code).
Rented items are non-refundable, except in the event of a proven defect upon delivery.
9. Returns and Refunds
Once the returned product is received and inspected, a refund will be issued using the same payment method used for the purchase, within a maximum of 14 days.
Damaged, washed, or worn items will not be refunded.
10. Rental of Items
Some creations may be available for rental for events, photo shoots, or exhibitions.
Rental terms (duration, deposit, condition, and return) are defined in a separate agreement signed between the parties when the item is handed over.
11. Liability
All products comply with Belgian laws in force.
Zohra Capucine cannot be held liable for any indirect damages arising from the use of the site or the products.
The seller’s liability is limited to the total amount of the order.
12. Personal Data
Customer data (name, address, email, phone number) is collected solely for order management and communication purposes.
Data is processed in compliance with the General Data Protection Regulation (GDPR).

13. Intellectual Property
All elements of the website (text, images, logos, designs, and creations) are protected by copyright and remain the exclusive property of Zohra Capucine / Productions Associées.
Any reproduction or use without prior written consent is strictly prohibited.
14. Governing Law and Jurisdiction
These Terms and Conditions are governed by Belgian law.
In the event of a dispute, both parties shall first seek an amicable resolution.
Failing that, disputes shall fall under the exclusive jurisdiction of the Courts of Brussels (Belgium).
